India Restaurant Labor Law Guide
About This Resource
Indian labor law is notoriously complex — different rules by state, overlapping central and state legislation, and frequent changes. Most restaurant owners either over-comply (paying for registrations they don't need) or under-comply (risking penalties they don't know about). This guide cuts through the complexity with restaurant-specific guidance. It covers: EPF (Employee Provident Fund) — when registration is mandatory (20+ employees), contribution rates, and compliance calendar. ESI (Employee State Insurance) — threshold (₹21,000 salary), employer/employee contribution split, and how to register. Minimum wages — current rates for the top 10 states with restaurant-relevant categories (skilled, semi-skilled, unskilled). Working hours — maximum hours, mandatory rest days, overtime calculation under the Shops & Establishment Act. Gratuity — when it applies (5+ years of service), calculation formula, and the new Labour Code implications. Updated for 2026.
